The Girona Provincial Court restores a client of Velasco Blaya Abogados’ family visitation rights
Restoration of visitation rights in favor of the biological mother under family law
Judgment number 24/2021, dated January 25, 2021, issued by Section 2 of the Provincial Court of Girona (presiding judge, Hon. Mr. José Isidro Rey Huidobro), partially upholds the appeal filed by Velasco Blaya Abogados law firm, specialists in family law in Girona, Blanes and Figueres, against the Directorate General for Child and Adolescent Care of the Generalitat of Catalonia (DGAIA), and agrees to grant the biological mother, a client of the firm, a visitation regime so that she may spend time with her minor son, to take place at the Supervised Visitation Center. This regime will be monitored and supervised by the designated professionals and, depending on the results, it may be expanded until the full restoration of the maternal parental authority from which she had been deprived.
Thus, the aforementioned judgment states that "(...) This does not mean that establishing a visitation regime with the biological mother, gradual, restrictive in principle and under the supervision of professionals, must entail any special risk for the minor, whose right to know the biological mother means that it may be considered favorable to the best interests of the minor".
The aforementioned judgment concludes that parents have the right to maintain a relationship with their children, even if they do not have parental authority.
