Conviction of a defendant for a sexual assault offense, a habitual domestic violence offense, and a continuing offense of minor threats

The Provincial Court of Girona issued, on February 6, 2008, judgment number 137/2008, in favor of a client of the law firm Velasco Blaya Advocats, Mrs. G.C.C. In this ruling, the defendant was sentenced for a continuing offense of sexual assault to 10 years and 6 months of imprisonment; for an offense of habitual domestic violence, to 1 year and 9 months of imprisonment; and for a continuing offense of threats, to 10 months of imprisonment.

In this proceeding, the lawyer Mr. David Velasco Blaya, head of the law firm Velasco Blaya Advocats, acted as private prosecutor, specialist in gender violence and criminal law in Girona, Santa Coloma de Farners, Blanes, Sant Feliu de Guíxols, La Bisbal and Figueres.

The judgment concluded, clearly and on solid grounds, that the repetition of violent behavior by the defendant was proven during the trial. This conduct generated a situation of ongoing suffering and a climate of systematic abuse, not only through attacks on the victim’s integrity, but also through the breach of the special duties of respect between persons united by these ties. All of this highlighted the need to protect human dignity and the family unit.
