The Court of First Instance of Santa Coloma de Farners issued on May 17, 2024, order number 197/2024 issued in the preliminary provisional measures procedure No. 407/2024-A in favor of a client of the firm Velasco Blaya Advocats, Mrs. M.M.A., by which it dismissed the request for preliminary provisional measures requested by her partner in a case of joint custody.

The plaintiff requested provisional measures from the court, based on allegations of supposed violent and negligent behavior of the mother towards their common daughter. The client opposed the claim, arguing that there was no risk to the minor and that the accusations were unfounded.

The judge concluded that there was not enough evidence to prove a situation of risk to the minor, highlighting the existence of contradictory accounts. Therefore, he dismissed the request as there were not enough indications to modify the current custody.
